The Will & Financial POA Package features a “stand-alone” Last Will & Testament document and a Durable Power of Attorney Over Assets (DPAOA) document. It also includes the Advanced Medical Directive (AMD). These documents are “stand-alone” meaning that they neither function with, nor are connected to, a Revocable Living Trust (RLT). The Will document does allows for the Testator to make dispositive directives over his estate, howbeit any assets passing to heirs through the disposition of the Will always need to be probated. The DPAOA can help avoid court-appointed conservatorship in cases where one becomes incapacitated and does not have a RLT in place.
The Health Care Document Set features the Advance Medical Directive (AMD). The AMD is an all-encompassing health care directive for third-party health care providers and physicians to refer to in making health care decisions on behalf of the principal (when the principal is not able) including with the directive of the AMD agent as applied. The accompanying HCDS documents can be used as a supplement to the AMD when determined by the client.
